Information about your tenancy

Both tenants and landlords have rights and responsibilities. You can find details of these in your One Vision Housing tenancy agreement. or ask at any neighbourhood Office. 

What is a tenancy agreement?

When you sign for a tenancy with One Vision Housing you will be given a tenancy agreement. This is a very important legal contract that tells you about your rights and responsibilities as a tenant and the rights and responsibilities of One Vision Housing as your landlord. Please keep in  a safe place.

Your One Vision Housing tenancy agreement is either a protected assured (non-shorthold) tenancy, an assured  (non-shorthold) tenancy or an assured (shorthold tenancy)

Protected assured (non shorthold) tenancy agreement

You will have been given this type of tenancy agreement if you were a Sefton Council tenant, who transferred to One Vision Housing on October 30th, 2006.

This type of tenancy agreement ensures that you retain the rights you enjoyed as a secure tenant of the Council after you transferred to One Vision Housing. It includes special succession rights and the Preserved Right to Buy.

Assured (non-shorthold) tenancy

You will be an assured tenant if you begin your tenancy with us on or after October 30th, 2006. This type of tenancy is offered to incoming tenants who have a current secure tenancy with either a council or registered social landlord.

Assured (Shorthold) tenancy agreement

New tenants, who have not transferred from Sefton Council under transfer of homes or from another council or registered social landlord, will be issued initially with anassured (shorthold) tenancy agreement.

Assured (shorthold) tenants do not have the following rights:

  • To 'succeed' to a property
  • To take in lodgers or to sublet their home
  • To make improvements
  • To apply for compensation for improvements
  • To carry out a mutual exchange

In effect, this type of tenancy agreement acts as a 'probationary tenancy' for new  One Vision Housing tenants and allows us to monitor the tenant for the first year and take legal action to terminate the agreement if necessary.

After 12 months an assured (shorthold)  tenancy will revert to an assured (non-shorthold) tenancy provided:

  • One Vision Housing has not started proceedings for possession against the tenant, or
  • One Vision Housing has not served a notice under Section 21 (4)  of the Housing act 1988 that possession is required

There will not be a requirement to provide a further tenancy agreement to assured (shorthold) tenants as a 'conversion notice' will be given to the tenant, who will then automatically gain the full rights of an assured (non-shorthold) tenancy agreement.
